These Terms & Conditions shall apply to all buyers, dealers, contractors, interior professionals, carpenters, fabricators, and end customers purchasing products from Bagga Sales.

By placing an order, the Buyer agrees to the following terms:

1. Product Selection Responsibility

The Buyer is solely responsible for selecting the correct product, finish, size, specification, model, application suitability, and quantity before confirming the order.

Products such as handles, locks, hinges, channels, profiles, furniture fittings, hardware accessories, and related items must be checked for design compatibility, dimensions, finish, and technical suitability before purchase.

Minor variation in shade, finish, texture, polish, tone, and appearance may occur between batches or due to the manufacturing process and shall not be considered a defect.

No claims regarding selection error, finish mismatch, compatibility issue, or design dissatisfaction shall be accepted once the material has been supplied, installed, or used.

2. Orders & Confirmation

Orders shall be treated as confirmed only after acceptance by Bagga Sales, whether verbally, digitally, in writing, or through invoice generation / payment confirmation.

Bagga Sales reserves the right to accept, reject, hold, or modify any order depending on stock availability, supplier availability, logistics, or commercial considerations.

Special orders, made-to-order items, imported items, and non-regular stock items shall be treated as confirmed only after advance payment or as per company policy.

3. Pricing & Payment

All prices are subject to applicable GST and other taxes as per Indian law.

Prices are subject to change without prior notice due to fluctuation in supplier pricing, transport costs, taxes, currency changes, or market conditions.

Unless otherwise agreed, payment terms shall be strictly as per the invoice / company policy.

Bagga Sales reserves the right to withhold dispatch or delivery in case of pending dues, overdue payment, or credit limit issues.

Any payment once made towards confirmed or specially arranged goods may be treated as non-refundable, subject to company discretion.

4. Delivery, Dispatch & Risk Transfer

Delivery / dispatch timelines are only indicative and may vary depending on stock position, supplier dispatch, transport conditions, weather, strikes, route issues, or other unforeseen circumstances.

Bagga Sales shall not be held liable for delays caused by third-party transporters, courier services, loading / unloading delays, or force majeure events.

Risk of loss, damage, shortage, or breakage shall pass to the Buyer once the goods are dispatched / handed over for delivery / collected from the shop or godown.

The Buyer must inspect all goods at the time of delivery / pickup.

Any issue regarding transit damage, shortage, wrong item, or visible breakage must be reported immediately at the time of receipt or within 24 hours of delivery, failing which the goods shall be deemed accepted in good condition.

5. Installation & Usage Disclaimer

All products must be installed and used strictly by skilled professionals / carpenters / fabricators / technicians, as applicable.

Bagga Sales shall not be responsible for any damage, malfunction, fitting issue, performance issue, or product failure caused by:

• incorrect installation
• wrong fitting selection
• wrong shutter / panel thickness
• uneven alignment
• poor workmanship
• misuse or overloading
• chemical exposure
• moisture / rust-prone conditions
• improper drilling / cutting / handling
• use of unsuitable screws, accessories, adhesives, or tools

No complaint regarding functioning, fitting, finish, alignment, adjustment, or damage shall be entertained after installation or use.

6. Quantity, Measurement & Project Requirement

The Buyer is solely responsible for verifying measurements, quantities, and project requirements before placing the order.

Bagga Sales shall not be responsible for shortage or excess requirement due to wrong estimation, site changes, design changes, or wastage during installation.

Customers are advised to order reasonable extra quantity / accessories wherever required for fitting, cutting, matching, replacement, or future maintenance.

7. Finish / Batch / Variation Clause

Where products are supplied in multiple pieces or at different times, uniformity in finish, tone, coating, polish, texture, or shade cannot be guaranteed across different batches.

For project consistency, the Buyer is advised to purchase the full required quantity in one lot wherever possible.

Such batch or finish variation shall not be considered a manufacturing defect or valid reason for return / replacement.

8. Warranty

Warranty, if any, shall be strictly limited to the warranty terms offered by the respective manufacturer / brand.

Bagga Sales acts primarily as a seller / dealer / distributor and shall not independently guarantee manufacturer performance unless specifically committed in writing.

Warranty shall apply only to genuine manufacturing defects, subject to inspection and approval by the respective brand / company.

Warranty shall not cover breakage, scratches / dents, finish fading due to usage or environment, rust due to moisture or site conditions, improper installation, misuse / overloading, accidental damage, wear and tear, poor maintenance, compatibility issues, or consumable / moving wear parts unless covered by brand policy.

A valid invoice / proof of purchase is mandatory for any warranty consideration.

9. Return, Exchange & Replacement

Goods once sold shall not be taken back, exchanged, or refunded, unless specifically approved by Bagga Sales.

Any return / exchange, if exceptionally allowed, shall be subject to all of the following:

• prior approval from Bagga Sales
• original invoice
• unused and undamaged material
• original packing in saleable condition
• acceptance by the respective supplier / brand where applicable

Special-order items, cut-length materials, customized goods, imported goods, non-stock items, opened fittings, and used / installed items shall be strictly non-returnable and non-refundable.

Any approved return / replacement may be subject to handling, transport, or restocking deductions, as applicable.

10. Breakage / Damage / Complaint Policy

No claim for physical damage, finish damage, missing parts, wrong handling, or visible defect shall be entertained after the goods have been installed, fitted, altered, cut, drilled, or used.

Any complaint must be raised before installation and with proper supporting photos / videos / inspection, wherever required.

Bagga Sales reserves the right to inspect the material or refer the matter to the manufacturer / supplier before approving any claim.

11. Limitation of Liability

In any case, the maximum liability of Bagga Sales shall be limited strictly to the invoice value of the concerned product only.

Bagga Sales shall not be liable for any labor / carpenter charges, site delay, project loss, business interruption, contractor penalties, reinstallation charges, transportation loss, or indirect, incidental, or consequential damages.

12. Force Majeure

Bagga Sales shall not be responsible for any failure or delay in performance caused by events beyond reasonable control, including but not limited to transport disruption, strikes / lockdowns, natural calamities, fire, flood, riots, government restrictions, supplier non-availability, import delay, war, or emergency conditions.

13. Dispute & Jurisdiction

These Terms & Conditions shall be governed by the laws of India.

Any dispute arising out of transactions with Bagga Sales shall be subject to the jurisdiction of the competent courts at Gurugram, Haryana, unless otherwise decided by the Company.
